Nope. We thought he was on his 3rd warning since last ban, but it turned out that it was only his second. Since he should not have been banned, the ban was removed.
As far as I can see, he has not tried to appeal the warning.

The confusion is rather common. A user can have 3 warnings in their history, but been warned only twice since they had their last ban. We usually can catch it when we double-check the user notes before banning.
