And whilst you sit behind your nice little 96 hours protection, there is even LESS time to hit them. Your *point*, is counter-productive

Actually there is MORE time to hit him sitting behind his 96 hour protection.
Unless he starts jumping to vacation mode, the standard 2 x 48 hour protections serve better because the game IS 24 hours live.
What is being suggested here is something that blatantly tips the game towards those with NO LIFE! And no willingness to risk anything. If you are worried about being massed, then there are all the usual time honoured solutions:
1. Build only what you can afford to lose
2. use critical and nox
3. BE a peaceful person/alliance
4. Surrender out of any wars.

96 < 40?

1) Aka, the massers whom build nothing but massive attacks, and token defenses and covert, since they attack units can't be killed
2) use critical and
nox, so that when you get phased, you get to sit there and do nothing, or get massed again (or finished)
3) I ONLY farm inactives, and often get hit, been masssed of mt 2T+ defense at least 2x
4) Aka, do nothing, and fight no one, in what everyone loves to quote "a WAR game"...
