Im a little confused and hope someone can help.

I was massed last night while I was sleep. After which my attacker gallantly took to foot and fled to the pergatory realm. Fortunately getting massed decimated my army enough to be under the pergatory unit threshold. So I foolishly went to follow my assailant and conduct a futile retaliation.

I quickly hit some of my normal realm farms to 'acquire' some $Naq. Raising war funds for my assured destruction. Then prepared to shift over.
When I clicked the cool 'Realm Shift!' Button(I think it should be in italics just to be even cooler) I was presented with this error:

You have either attacked other realms in the last 2 days, or been on vacation/ppt within the last 2 days (or are now), or moved to/fro in the last 2 days. To go into or out of pergatory, you need a period of repentance or peace. In this place, that takes 2 days of no attacking others. Additionally, you must have been in full active play (no ppt, no vacation) for the last 2 days.

Again, it must be minimum 48hours.

Which finally brings me to my conundrum, My assailant's last attack on me was 10 hours ago. How did they manage to move to pergatory, seemingly circumventing this 'wait 48 hours' clause?

This belongs in the bug section of the forums.

Admin will probably need your ID and the ID of the person that hit you, also do not delete any of the attack logs that way admin can check your account also, incase there is a bug being exploited.

did they the attack/raid function on you or just use the sabotage?

it was me, i didnt think about it till i read this.
Asked jason on skype, was a bug but sorted now.
