At 13:46 game time today my planet was stolen by verna .
13:46 Verna [fahQ] Protected by tweetygirl lost 15 0 0 18,480,000 29,779,200

I go to steal it back then i find that verna has no planets how can this be if my planet cant be stolen from verna again for 24 hours then where is my planet ??? is this a bug or am i missing something ????

I think they can still abandon them, not sure.

now if they 'throw it away' .. well... that is their option too -- once you hold onto something, it is always your choice to fight to keep it, or destroy it in order to avoid the fight over the item .... never is it 100% sure though that you will not get a whooping just for doing what you did though but you at least ensure the fight is not over possession !
