I think that has been changed now to reflect ATT and DEF seperately.

You can only have 105.00 percent (base of 25 plus 80 percent in upgrades) of your trained troops as mercenaries.
Beyond that, you do not have enough troops loyal to you to ensure compliance to your orders.
You now have:
0 Trained Mercs.
2268000 Trained Military Units.
You can have a maximum of 2,381,400 Trained Mercs.
ADDITIONALLY - each Merc (attack or defence) is paired with a 'super soldier' (attack or defence). This means that you can only have as many attack/def Mercs as you have supers of that type. (plus 10% for each merc level)
