Hey, lets start a Anti-America thread. I'm sure if nice ol' Canada wanted to extradite this guy no one would be complaining.
Below Me.

ok simply put the crime was committed in the US borders because the information stolen was AMERICAN INFORMATION and furthermore this man did not have the need to know or the clearance to obtain said information through legitimate channels
on another note you ask if soldiers should be punished in accordance to the laws of the country they are in, you will find that they have been in the past tried by an international court in accordance with the Geneva Convention
as far as being tried as a terrorist it is true he should be tried as such due to the penalty for accessing information to which he had absolutely no right to in the first place, he did not sign an NDA nor was he authorized by anyone to access sensitive information stored on private servers.......
I do agree that 50 years is a bit much if he was just looking for aliens but he did commit a crime against the US and as such should be tried in the US

Again the crime was psyhically commited inside the UK under UK jurisdiction and should be tried under UK laws inside UK borders.
Yes it was commited against the US, but not inside the US borders or under US jurisdiction so extradition makes no sense.
EDIT: and he isnt by any definiation a terrosrist so lets put that out the window, or are you really trying to say hes up there with the taliban leaders et all?
An international court isnt trying soldiers in the country they commited the crime in however

ok hypothetical situation KF,
I kill the Prime Minister of England in Germany the UK wishes to extradite me, by your argument I would have to be tried in Germany despite the wishes of the UK to extradite me......
and no the crime was actually committed over the internet which is a virtual system and as such the crime will be tried wherever the servers that are being offended or in this case stolen from reside which is in the US

If I commit a major crime in another state, I am to be punished in that state.
That also applies to countries. He committed a crime in the US, he should be punished by the US. The crime(stealing information) was committed on the computers/servers located inside the US, therefore, the crime was committed inside of the US.

I know full well its pointless as you arent listening to a word i'm saying however I provide here a quote from Rt. Hon. Lord Carlile of Berriew QC, who was the UK govs reviewer on terrorism laws
The Government has argued that it cannot prevent the extradition as a matter of law, and has no discretion in the case.
However, it is wrong. According to the law, an offence can be tried in England and Wales, provided the conduct or its consequences took place in England and Wales.
Gary McKinnon's conduct was in England. He can be tried in England.
