US Miranda Rights To Be Changed

http://www.google.com/hostednews/ap/article/ALeqM5gni2seh8bCKwfEfxeA6Unf6tHqHgD9HB71O80

This is a ridiculous decision by The Supreme Court, in my opinion. But I am sure someone *cough*Jack*cough* will disagree with me and I'd like to hear other people's opinions on this.

Re: US Miranda Rights To Be Changed

Miranda always reminds me of this scene from Red Heat

Hooligan: Hey, *NaughtyWord*! You can't park here, this is my spot! I live right up there. So move your piece-of-*NaughtyWord* car or give me fifty bucks.
Ivan Danko: I do not understand.
Hooligan: Let me make it real simple, moron. You move your ass or give me fifty, or I take my Pete Rose here and *NaughtyWord* mutilate your car.
Ivan Danko: Do you know Miranda?
Hooligan: Never heard of the *NaughtyWord*.
[Danko punches him unconscious]
Ivan Danko: [in Russian] Hooligani.
[Ridzik comes back]
Art Ridzik: Everything okay?
Ivan Danko: Yes, fine. No problems.
Art Ridzik: What about that sack of *NaughtyWord* lying on the sidewalk?
Ivan Danko: He lives here.

The percentage of people that would have to "worry" about this is sooooo low as long as you never actually break the law that it should not even matter:roll:.

Re: US Miranda Rights To Be Changed

no offence america is massive and lots of places have inadequate education lots of people slip through what if one gets arrested will have trouble understanding perhaps this new version. I hate to use that against people but this can be abused #-o and if pressures on to get conviction cops will sometimes do anything pick on a weak person known locally who think can get confessions on

Ahh yes the cry of the misinformed, the uneducated, the opressors & the tyranty through all of recorded history.

Seriously do you really believe what you wrote?? If you do your dumber than than you sound, the sheer scope of arrest powers in places like the US/UK/Aus/Canada (all of which share a common basing of common law) Means that you can be aressted and held for pretty much anything the officers invovled care to say.

Such things as Miranda in the US are there to try and help curtail that power so you dont find yourself at the mercy of unaccountable pigs in uniform. If you let them go, more fool you!

This coming from the people who are attempting to have "intelligent" discussions on an obviously overwhelmingly childish gaming forum? Don't make me laugh...

Now you are going to make me waste time typing to point out how thick headed and stubborn you are (not you KMA). This is hilarious how upset you get over someone dis-agreeing with you.

Now go cry more how criminals like yourself will be easier to be charged with the crime they committed and waste less resources doing so. I will continue to follow the laws of the country and state in which I live and never have to worry about this no matter how much tweaking is done.

"Criminal suspects must now unambiguously invoke their right to remain silent — which counter intuitively requires them to speak," she said. "At the same time, suspects will be legally presumed to have waived their rights even if they have given no clear expression of their intent to do so."

If you say nothing, cops can presume that you are waiving your rights.

Re: US Miranda Rights To Be Changed

Its depressing sometimes reading posts from people with as much understanding of the realities of life as a jelly baby.

I do so hope that you fully understand your rights, and all of them at that too which of course arent ever taught to you at school or anything & that you never annoy a neighbour or anyone in fact who decides to maliciously make a report to the police about you. Or even just deciding to ask a child something in the street like the time, better hope no bystanders are about thats peadophile behaviour don'tyaknow (or so everyones told by the media these days)

There are so many ways to get aressted without breaking the law, that you cant see them is quite simply amazing.

MK, you have completely missed the point KF was trying to make you understand. also understand that KF can be quite passionate at times...just like many others (including me) who frequent these boards, so dont judge to harshly :-)

on to the point KF was trying to make...

“First they came for the Communists, but I was not a Communist, so I said nothing. Then they came for the Social Democrats, but I was not a Social Democrat, so I said nothing. Then they came for the trade unionists, but I was not a trade unionist, so i said nothing. And then they came for the Jews, but I was not a Jew, so I said nothing. Then when they came for me, there was no one left to speak up for me.”

get the point now mate?

Yes, you can go your whole life without ever being arrested or even questioned by the police. But keeping yourself clean of drugs and never driving over the speed limit and following all the rules and laws does not guarantee that you will be one of those people. Majority of people never enter a situation like that. But can anyone know for sure they will be part of the majority?

If I'm ever arrested, I will know my rights simply because I am family with law enforcement officials. But most people aren't that lucky, and most people don't read stories that aren't considered "BREAKING NEWS", so they will never know that if they want to keep their right to remain silent, they will have to state, "I would like to invoke my right to remain silent." The whole reason for Miranda Rights to be read in the first place was to inform the uninformed of what their rights are and how they can be used. By no longer informing them, the person of interest/suspect/whoever will remain uninformed and will not be treated in a "fair" manner. Which will waste even more money as lawyers appeal decision after decision based on the fact that their clients were not informed.

Honestly, my biggest problem with this decision is that it can easily be the beginning of more severe changes in the court process. Yes, changes need to be made, because the system is far from perfect, but I feel as if this is a change in the wrong direction.
