Yes, you can go your whole life without ever being arrested or even questioned by the police. But keeping yourself clean of drugs and never driving over the speed limit and following all the rules and laws does not guarantee that you will be one of those people. Majority of people never enter a situation like that. But can anyone know for sure they will be part of the majority?

If I'm ever arrested, I will know my rights simply because I am family with law enforcement officials. But most people aren't that lucky, and most people don't read stories that aren't considered "BREAKING NEWS", so they will never know that if they want to keep their right to remain silent, they will have to state, "I would like to invoke my right to remain silent." The whole reason for Miranda Rights to be read in the first place was to inform the uninformed of what their rights are and how they can be used. By no longer informing them, the person of interest/suspect/whoever will remain uninformed and will not be treated in a "fair" manner. Which will waste even more money as lawyers appeal decision after decision based on the fact that their clients were not informed.

Honestly, my biggest problem with this decision is that it can easily be the beginning of more severe changes in the court process. Yes, changes need to be made, because the system is far from perfect, but I feel as if this is a change in the wrong direction.


Me = people stop being lazy and arrogant and learn the laws that govern you.

The rest of you = help American's be even more lazy and stupid by handing everything to them on a platter.

That is the jest of it right?

your rights are only supposed to be read to you if your arrested for a felony,

and in certain states in the usa they are never read to you at all unless your are question, sometimes that is only when you have finally been taken to court. How do I know well in my younger day Before My wife settled me down. Lets just say I had my share of run ins with he law.

But back to my point, the law is bent by those that enforce it (hopefully in attempt to protect the innocent) all the time , Its why so many criminals get aways with crimes. So I say Good let them have more lean way, cause I will say from experiences if you stay out the kitchen you wont get burned.

I havent been in any trouble (besides a speeding ticket) in well over 10 years so give them hell cops and keep them off the streets.

2) They weren't serious charges.

You mean they actually stayed? :shock: When I got rear-ended and pushed into a Thunderbird (sad story), a patrol car showed up next to my totalled car, glanced at our licenses, and drove away.

Car accidents are not a matter for the police unless it is a hit-and-run.

Lazy and arrogant are not mutually inclusive traits.

Also it is unlikely that anyone knows every law in the area where they live, especially since the laws change so frequently.

I'm not expecting things to be handed to anyone on a platter. But I do believe that this decision could set a precedent for future decisions by this Supreme Court.

Well for my money it doesn't really matter. Just because the police can continue questioning you doesn't mean that you have to answer. The change is more procedural than anything else. Everyone with any sense knows that you don't have to talk to the police. I mean come on who doesn't know the Miranda warning by heart anyway

Actually it does matter & it isnt all procedural. Say for example you are arrested, you dont say anything and exercise your right to silence. Before this change that was all you had to do, you couldnt be compelled or penalised for keeping quiet.

Now with the change, if you dont tell them you are exercising your right to silence (and therefore speak) they can assuming you are waving it, which means should your case ever reach court your continued silence could lead to you being held in contempt at least as the court would have the power to command you to answer, failure to do so well quite simply thats contempt.

How is this hard to grasp for some people?

Whatever happened to enlightened self interest? Its not about just punishing criminals its about making a fair and balenced legal system that treats everyone fairly (regardless of any previous interations) & whether you like it or not that is the only way a legal system can operate & these change upset the tenuous balence of fair rights, without tying the polices hands.

Anyway you also have a childish view on justice as well. More and more i see police only care about convictions rather than catching the criminal. Waining standards on police, offers only to further illustrate the decline in your justice system. The US has 12% of it's population in jail, it's estimated 1% percent of those are innocent. But obviously Mikgamer doesn't care about that as long as he has his "lulz"

I actually agree with Psyko, Thriller and the others.

Miranda warnings aren't to protect you from your own ignorance, but rather to protect you from corrupt cops, of which there are far too many.

Russia is actually quite forthcoming in the field of a fair police. Most cases i've seen/heard of/ and so on result in police detaining the "bad guy" with force ONLY IF NEEDED. I'd rather live in Russia then in any other country tbh. :-s
